Colorado community in mourning after fatal collision

On Behalf of | Apr 24, 2023 | Wrongful Death

A GoFundMe page has been created to help a grieving Colorado family who has been suddenly faced with funeral expenses and other financial distress due to a tragic accident. The family suffered the unexpected loss of one of its members, a 9-year-old girl. She was struck by a motor vehicle on a recent Tuesday evening.

A preliminary investigation showed that neither excessive speed nor alcohol or drugs are suspected as causal factors in the collision that ultimately took the life of a child. While she initially survived her injuries after being struck by a car, she died in the hospital the next day. The child’s family said she was well-known and loved by so many people in her community and often delighted other children and neighbors with her artistic talents.

An investigation of the fatal collision remains active

When a preliminary investigation rules out certain issues, such as alcohol or drugs, as factors in a fatal collision, it does not necessarily mean driver negligence was not a primary cause. Investigations sometimes take days or weeks to conclude what or who may have caused an accident and whether a driver’s negligence was responsible for the injuries that occurred. Grief is always intensified when a collision results in a child’s death, and a parent’s ability to cope is often closely linked with the results of an investigation.

When a child has died because of driver negligence

Most fatal Colorado collisions are later determined to have been preventable. To date this year, there has already been nearly double the number of fatalities attributed to Colorado Springs car accidents than there were in total for the same period in 2022. A parent or legal guardian who has lost a child because of a driver’s negligence may seek restitution for damages by filing a wrongful death claim in civil court.
