Don’t settle for less – the definitive car accident guide – and our favorite BBQ

Team Dispatch

Hello friends,

It’s been a busy late summer here at Shafner Injury Law. Several of our clients’ cases are now headed to court, and we’ve spent the last few months deep in preparation mode: reviewing records, consulting experts, and building the strongest case possible for each person we represent.

Not every case goes to court, and none are guaranteed to go our way, so we never promise an outcome we can’t control. What we can promise is that we pursue every avenue available—every witness, piece of evidence, and legal argument—until we’re satisfied we’ve done everything we can. That’s true whether a case settles at the negotiating table or in front of a jury.

An injury doesn’t just interrupt a person’s life for a few weeks; it can reshape how they work, care for their family, and see their future. Our job is to make sure the people we represent have every resource available as they recover: medical care, fair compensation, and the time and support it takes to get back to a life that feels like normal again.

As this season winds down and these cases have their day in court, we want to say thank you—to our clients for trusting us with something this personal, and to everyone who supports this work behind the scenes. We’re proud of what this team has built, and we’re not slowing down.

With gratitude,
Alan, Allie, and Molly (and Beau and Ollie)

Beau and Ollie: Chief Morale Officers

While the humans of Shafner Injury Law have been buried in depositions and trial prep this summer, the real work of keeping office morale up has fallen to our two hardest-working (and hardest-napping) team members, Beau and Ollie.

Beau has taken over “client greeting” duties with the seriousness of a partner who bills by the tail wag, meeting every visitor at the door like they’re the most important person to walk in all week. Ollie, meanwhile, has been running quality control on every fallen snack crumb and Zoom call.

Between the two of them, snoring through strategy sessions and demanding belly rubs on the hour, they’ve made sure that even on the busiest days someone around here still has their priorities straight. So if a case update comes with a little extra dog hair on it this month, you’ll know why—and you’re welcome.

P.S. We’d love to feature your pet in an upcoming newsletter. Send us a photo and your pet’s name, age, and a few fun details to beau@shafnerlaw.com.

Legal Tips

5 signs your settlement offer is too low

5 signs your settlement offer is too low

A fast settlement offer can feel like a win because you want this terrible situation behind you, and a number on the table looks like the easiest way to move on. Before you sign anything or cash that check, we encourage you to pause and look at how the offer arrived.

Here are five signs the offer is lower than it should be.

  1. It arrived before you finished treatment. If you’re still seeing a doctor, in physical therapy, or not sure how long your recovery will take, the insurance company doesn’t know your full costs yet, and neither do you. An offer made this early is a guess, and it’s their guess, not yours.
  2. It came with a deadline. “This offer expires in 5 days” is designed to make you decide before you’ve had time to think it through or talk to anyone about it. A fair offer holds up to scrutiny. One with an expiration date usually doesn’t want you looking too closely.
  3. The number only covers your ER bill. If the offer roughly matches your emergency room charges and nothing else, it doesn’t account for follow-up care, missed work, ongoing pain, or the possibility that your injury turns out to be worse than it looked on day one.
  4. The adjuster is unusually friendly and pushing you to skip a lawyer. A kind, helpful tone can be genuine. It can also be a strategy to make you feel comfortable enough to accept quickly. If someone from the insurance company is actively discouraging you from getting a second opinion, ask yourself why that matters to them.
  5. You haven’t added up your own numbers yet. If you can’t estimate what your medical bills, lost wages, and ongoing care will likely total, you can’t tell whether their number is fair. They’ve run the math on their side. Make sure someone runs it on yours.

This doesn’t mean every fast offer is bad, but a fast offer deserves a closer look before you accept it, not after.

Community Impact

Drunk driving is entirely preventable, yet our team sees its devastation up close — in the lives of clients who were simply going about their day when someone else’s choice changed everything. MADD has been fighting to end drunk driving and support survivors for over four decades, and their work — from victim services to legislative advocacy to prevention programs — makes a real difference in communities like ours. We’re proud to support them and invite you to join us in donating.

We Love Our Clients

“I am very grateful that Allie, Alan, and their team helped me during a very difficult time in my life! They went to bat for me with the insurance company when others would not. They were very dedicated and helped to finally close the case!”

What Happens After an Injury in Colorado?

From Legalese to Plain English

What is Comparative Negligence?

One of the most common strategies insurance companies use after an accident is to argue that you were partly at fault. Understanding how comparative negligence works can help ensure you get what you deserve instead of accepting less.

Comparative negligence is the legal framework that determines how compensation is divided when more than one party shares responsibility for an accident. If you’re found to be 20% at fault and your total damages are $100,000, you would receive $80,000.

We serve accident victims in Colorado and Wyoming, and both states follow a “modified comparative negligence” rule, which means you can still recover compensation as long as you are less than 50% at fault. At 50% or more, you recover nothing, and insurance adjusters often try to assign you as much fault as possible. This is why it’s so important to document your case with a lawyer as soon as possible after the accident.

Remember: if an insurance adjuster claims you were partially to blame, it’s not the end of the story. In fact, it’s often the beginning of a negotiation.

Local Gems

We believe that supporting local businesses in the regions where we practice helps everyone thrive! This time, we’re sharing our favorite BBQ.

COLORADO

Post Oak Barbecue

When we can’t get to Texas, we satisfy our cravings at Post Oak. Their dirty mac and cheese with brisket is a family fave, and always topped off with banana pudding. Bonus fun: you can tour the smoker with the kitchen crew.

WYOMING

A Little Taste of Texas

Cheyenne’s top-rated BBQ is served fresh out of a food truck. The owner (from Texas) smokes brisket, turkey legs, and pulled pork that Texan reviewers consistently say tastes just like home. You can follow them on Facebook.
